Professional Experience
Katharine A. Kates' practice focuses on complex civil and commercial litigation.

Ms. Kates has represented both plaintiffs and defendants in a broad range of matters involving securities, business torts, breach of contract, trade secrets, intellectual property, and insurance coverage. In addition, Ms. Kates has considerable experience handling state and federal appeals.


Recent matters include:
Assisted David Rosen in defending directors and preferred shareholders of a publicly traded company in a securities class action in which plaintiffs alleged that defendants breached their fiduciary duties by selling the company's assets and distributing the proceeds to the preferred shareholders, leaving nothing for the common shareholders. After a four week bench trial, the Court ruled that defendants did not breach their duties and that the transaction was fair to the common shareholders.

Defended a law firm and several of its lawyers against three separate lawsuits alleging malicious prosecution. In each of the three cases, the firm successfully moved to strike the complaint pursuant to the "anti-SLAPP" statute, and the clients were awarded their attorneys' fees and costs.
Represented a publicly traded wholesale mortgage lender in a lawsuit brought by a competitor alleging theft of trade secrets, interference with contract, fraud and unfair competition. After defeating the plaintiff's attempt to obtain a preliminary injunction, the matter settled very favorably for the client.
Obtained summary adjudication of liability on behalf of an internet advertising company in a breach of contract action brought against an on-line dating service. The case settled favorably with damages the sole remaining issue.


Other matters handled by Ms. Kates during her career include:
Represented plaintiff in securities fraud claim against a publicly traded company in which a multi-million dollar settlement was obtained.
Obtained appellate ruling affirming $1.3 million jury verdict in a dispute arising from the sale of telecommunications software to an international telephone company.
Obtained a ruling negating the effect of a world-wide injunction freezing the assets of a foreign national residing in California.
Represented defendant in criminal securities prosecution which established Ninth Circuit requirement that government prove actual use of material non-public information to establish insider trading.


Community/Professional Activities
Ms. Kates devotes a significant amount of her time to community causes, including the Turning Point Transitional Housing Shelter and the Sojourn Shelter for Battered Women and their children.
